You must read the Nodster.co.uk Privacy Policy and Terms of Service (this document), prior to using any portion of the Nodster.co.uk service. These documents are subject to change without notice. Terms of Service:

DEFINITIONS:

Nodster.co.uk is a Web site ("Site") owned and operated by Paul Noden Nodster.co.uk and Paul Noden may be used interchangeably in these Terms of Service ("Terms"). A "User" is defined as any person who establishes a connection to or accesses any Nodster.co.uk related materials. These Terms are a binding agreement between you, the User and Nodster.co.uk.
DESCRIPTION OF SERVICE:

Nodster.co.uk provides Users with the capability to store and maintain personal details on yourself, whilst also being able to locate details on many other users, post messages in a community forum, and vote on issues reflecting the site or other topics. In consideration for this service, Users agree to comply with the Terms as laid down under this Terms of Service Agreement.
TERMS SUBJECT TO CHANGE:

Nodster.co.uk shall have the right at any time to change or modify the Terms associated with the use of Nodster.co.uk, or any part thereof, as well as to impose new Terms. By using Nodster.co.uk, you agree to be bound by any such revisions. Users should visit Nodster.co.uk periodically to determine the conditions of the binding Terms.
USER CONDUCT AND USE OF SITE:
1. User agrees to use Nodster.co.uk for lawful purposes only. User agrees to the Terms of Service and Privacy Policy. User shall not post or transmit through Nodster.co.uk any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which contains advertising or any solicitation.
2. Nodster.co.uk is not in any way associated or responsible for the content of its users. Nodster.co.uk has created the Nodster.co.uk Terms of Service in order to assure that its electronic service is used in a lawful and appropriate manner. While Nodster.co.uk does not ordinarily monitor the content of users' submissions, it reserves the right to disclose data to proper authorities who may investigate reports of misuse or abuse of this service.
3. Nodster.co.uk is not responsible for the content of the submissions created. All users post at their own risk. If you have received abuse you believe may have originated through the service, you should contact us with an exact copy of the email (including headers where possible) so Nodster.co.uk, in its sole discretion, can determine whether or not to remove the information. This process may take up to 30 days.
4. All legal matters are to be directly between the submitting user and the reader. By using Nodster.co.uk the submitter and reader have agreed to hold Nodster.co.uk free from all liability associated with their use of Nodster.co.uk. Nodster.co.uk is not associated nor responsible for the content of any users submission.
5. Nodster.co.uk contains copyrighted material, trademarks, and other proprietary information including but not limited to Web site design, concept, programming, files, and data. The entire contents of Nodster.co.uk is copyright of Paul Noden. Users of Nodster.co.uk may not modify, publish, transmit, translate, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. No copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted. Users of Nodster.co.uk acknowledge that they do not acquire any ownership rights by downloading copyrighted material.
6. Users of Nodster.co.uk shall not upload, post or otherwise make available on Nodster.co.uk any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any area of Nodster.co.uk, the User automatically grants, or warrants that the owner of such material has expressly granted Nodster.co.uk the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and / or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. The User also permits any other User to access, view, store or reproduce the material for that User's personal use. The User hereby grants Nodster.co.uk the right to edit, copy, publish and distribute any material made available on Nodster.co.uk by the User.
7. In addition all users of Nodster.co.uk shall not publish through Nodster.co.uk any materials that are deemed to be unsuitable, including but not limited to material that is libelous, defamatory, threatening, abusive, disparaging, indecent, obscene or pornographic. Nodster.co.uk expressly disclaims any liability for any such messages or files that are posted or transmitted.
8. Users relinquish any and all rights to suggestions, ideas or other content that you submit to Nodster.co.uk. The act of submitting suggestions, ideas or other content to Nodster.co.uk does not, in itself, create an agreement of any kind between the submitter and the site. Nodster.co.uk reserves the right to freely use and modify the submitted suggestions, ideas or other content without first obtaining consent from the submitter.
DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY:
1. Use of the Nodster.co.uk service or access to any portion of Nodster.co.uk is done at the sole risk of the User.
2. Nodster.co.uk shall not be held liable for the receipt of any unwanted e-mail resulting from or associated with Nodster.co.uk. Similarly to any e-mail sent from a User of Nodster.co.uk to another party, Nodster.co.uk will not be held responsible for the content of this e-mail or any content linked to in the email including but not limited to Nodster.co.uk submitted content, or for preventing this e-mail transmission. In the event that Nodster.co.uk is able to remove a party from any distributions directly associated with Nodster.co.uk or any associated third-party, Nodster.co.uk will do so to the best of its ability. At no time will Nodster.co.uk be held responsible for any inability to prevent e-mails from being sent to any party including but not limited to negligence, error, or loss of data.
3. Nodster.co.uk service is provided on an "as is" basis without warranties of any kind, either expressed or implied, including but not limited to availability of service and data.
4. This disclaimer of liability applies to any damages or injury caused by any availability of service, error, deletion, theft, alteration, or destruction of data, computer virus, tortuous behaviour, negligence, or any other cause of action or inaction. The User of Nodster.co.uk assumes the entire cost of all damage, servicing, repair, or correction either emotionally, physically, or monetarily resulting from the use of Nodster.co.uk in any manner, including but not limited to the offensive or illegal conduct of other Users or third-parties of Nodster.co.uk. The risk of injury, loss, or damages from use of Nodster.co.uk either directly or indirectly rest entirely with the User. Additionally, in no event will Nodster.co.uk, Paul Noden, or any person or entity involved in creating, producing or distributing content on Nodster.co.uk be liable for any damages, including without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use any portion of Nodster.co.uk including but not limited to links to third-party content, submitted content, and all content of a Nodster.co.uk User hereby acknowledges that the provisions of this section shall apply to all content on Nodster.co.uk.
5. In addition to the terms set forth above, neither Nodster.co.uk, nor its affiliates, information providers, or third-parties shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or unauthenticity of the information contained within or associated with Nodster.co.uk or for any delay or interruption in the transmission thereof to the User, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither Nodster.co.uk nor its affiliates, information providers or content providers warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.
PAGING SERVICE:

Nodster.co.uk reserves the right to at their discretion withhold refunds for failed pages to cover the proportionate use of any working portions of the paging system. Any remaining amount will be refunded as per Nodster.co.uk refund policy allows.
REFUNDS:

Nodster.co.uk reserves the right to at their discretion withhold refunds for services to an amount that will cover Nodster.co.uk's costs for existing work done or purchases made on the customer's behalf. Any remaining amounts will be refunded as per payment method's policies allow.
UPDATES TO SITE:

Nodster.co.uk reserves the right to modify Nodster.co.uk and the materials contained within at any time without prior notice.
ADVERTISING ON THE SITE:

Nodster.co.uk may contain various types of advertising, including but not limited to banners, popups and text links. The relationship between you and a Nodster.co.uk advertiser shall be controlled by the Policy and Terms found on an advertiser's Web site. Nodster.co.uk is not responsible for the Policies, Terms or Practices of other sites linked to Nodster.co.uk. Nodster.co.uk encourages Users to read the Policies and Terms of Web sites when they connect to them through Nodster.co.uk. Nodster.co.uk is not responsible for any losses you may incur from doing business with a Nodster.co.uk advertiser.
INTERNATIONAL USE:

Neither Nodster.co.uk nor its affiliates makes any representation that Nodster.co.uk or its content are appropriate or available for use in locations outside the United Kingdom. You may not use or access Nodster.co.uk from territories where the content of Nodster.co.uk is illegal or prohibited. Users are bound by the local laws from which they access Nodster.co.uk.
GOVERNING LAW:

Users agree to the laws of the United Kingdom, by using Nodster.co.uk in any manner. Without regard to principles of conflict of laws, the laws of the United Kingdom will govern these Terms and any dispute of any sort that might arise between you and Nodster.co.uk.
CONCLUSION:

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. If any provision of this agreement is unlawful, void, or for any reason unenforceable, then it is the User’s responsibility to refrain from using or accessing any portion of Nodster.co.uk.
